In the context of certain claims, particularly in Civil Liability and Defense and Recourse, we will speak of third parties.
👉 In a nutshell : A third party is any person who is not insured by your contract.
But there's a bit more to know. Some people are automatically covered by your civil liability contract, whether you add them as beneficiaries or not, because they have a connection to you. Because of this, a number of people cannot be considered third parties :
All persons living with you
Your ascendants or descendants
Your service employees
Your pets
Therefore, if these people cause damage to you, it is impossible to make recourse to their civil liability : it's the same contract as yours.
For example:
If I break a friend's TV while having dinner at his house, it will be covered by my civil liability coverage, because my friend is a third party : he is not one of the people covered by my policy.
If my child drops my phone and breaks it, it will not be covered by my civil liability coverage, because my child is one of the insureds on my policy.
☝️ Note :
Goods that have been entrusted to you cannot be covered by your civil liability guarantee, because they are covered by your home insurance (so it is not a third party's property). If you damage them, you will have to see if the other guarantees of your contract can cover it.
For example :
If you are renting your home equipped with a cooktop, and you damage it, we will not be able to cover that under civil liability, because that property was entrusted to you by your landlord.
Similarly, if a friend entrusts you with his game console, and you damage it while it is installed in your home, this will not be covered by your civil liability coverage.
